Program:
Strategic Innovation Fund - Indigenous Capacity Support Prog
Program Purpose:

The purpose of this program is to issue capacity funding to indigenous governments so that they can meaningfully participate in consultations with the Government of Canada. The Crown has a legal duty to consult (DTC) and, where appropriate, accommodate Indigenous Peoples when it considers conduct that might adversely impact asserted or established Aboriginal or Treaty rights. This duty was affirmed by Supreme Court of Canada in a number of decisions, and consultations are required to be meaningful by legal precedent. Not providing capacity funding could jeopardize the Honour of the Crown should the consultations be reviewed judicially for established standards of reasonableness and correctness.
