Description:
The President of the Treasury Board is responsible for the general administration of the Access to Information Act and the Privacy Act. Part of these duties is conducting a mandatory review of the Access to Information Act every five years, pursuant to subsection 93(1) of the Act. This project will result in a written submission to inform the next mandated review. Additionally, Treasury Board of Canada Secretariat is reviewing the Privacy Act with the intention of preparing a report on possible legislative updates. The research conducted by the recipient will respond to Treasury Board of Canada Secretariat policy approaches and provide further insight into challenges affecting Indigenous peoples related to access to information, personal data, and privacy, as well as opportunities for improvement.
The project will also support the ongoing implementation of the United Nations Declaration on the Rights of Indigenous Peoples Act by examining impacts that the Access to Information Act, the Privacy Act, and potential policy approaches may have on Indigenous rights and interests described in the UN Declaration on the Rights of Indigenous Peoples. Overall, the project directly supports Treasury Board of Canada Secretariat legislative obligations and mandate. It will help strengthen the federal access to information and privacy regimes, and in turn, the effectiveness of public service management.

Expected Results:
The expected outcome is to increase the Government of Canada’s understanding of challenges impacting Indigenous peoples’ access to, and protection of, information, personal data, and privacy, while obtaining feedback on policy approaches put forward by the Government of Canada.
