Issue/Question:

On May 5, 2021, the FCA dismissed an appeal filed by the Attorney General of Canada against the 2019 decision of the Federal Court. The FCA has remitted the matter back to CFIA for redetermination.

Suggested Response:

• The Federal Court of Appeal has remitted the issue to the CFIA for a redetermination. I am not in a position to comment further on this regulatory matter at this time.
• The redetermination by the Canadian Food Inspection Agency (CFIA) is a domestic regulatory matter.
• The Canada-Israel Free Trade Agreement (CIFTA) does not contain specific obligations related to product labelling.
