Suggested Response:

• The Government of Canada recognizes the cultural, economic, and historical importance of cod to Newfoundlanders and Labradorians.
• The science indicates that 3Ps cod off the south coast of Newfoundland is in a critical state.
• My department’s precautionary approach framework calls for fishing levels to be kept at a minimal level when a stock is in this state.
• I recognize the challenges this decision will place on some fish harvesters; this decision was not made lightly.
• It is important that we intervene now; to protect this cod stock, focus on rebuilding it, and ensure the long-term sustainability of this fishery. We have a duty to manage our resources responsibly for future generations.

Background:

• The 27th annual Canada-France Advisory Committee meeting to negotiate co-managed stocks will occur virtually March 23-24, 2021. The purpose of the meeting is to seek agreement with France (in respect of Saint Pierre and Miquelon) on the management regime for co-managed stocks, including the total allowable catch (TAC) for 3Ps cod, for the 2021-22 fishing season.
• The latest spawning stock biomass estimate places 3Ps cod in the critical zone, where it has been for a number of years.
• Canada’s mandate last year was to seek no directed fishery in 2021-22 in the absence of stock improvement; a possibility that was captured in last year’s negotiation record of decision.
• Canadian industry stakeholder groups have unanimously recommended a TAC rollover for 2021-22, noting the 58 per cent probability of growth, as well as the 55 per cent TAC reduction last year.
• Consistent with DFO’s Precautionary Approach Framework, and last year’s negotiating position, the Minister approved a mandate to seek no directed fishery for 3Ps cod for the 2021-22 fishing season. France has informed Canada that it may seek a reduction in the TAC, but it did not specify by how much. For other co-managed stocks, TAC rollovers will be sought.
• There will likely be a strong negative reaction, particularly from inshore harvesters, to this decision. Media interest can be expected.
• Not having a directed fishery prohibits fishing efforts targeting 3Ps cod. While harvesters would still be permitted to retain a limited amount of cod as bycatch, in accordance with bycatch limits, we recognize the impacts of this decision on industry but also the need to promote growth in the stock.
