Issue/Question:
On August 19, 2020, the Minnesota Department of Commerce (DOC) filed an appeal with the Minnesota Court of Appeals of the Minnesota Public Utilities’ (PUC) order that found the Line 3 Environmental Impact Statement adequate, and that granted a Certificate of Need and Route Permit to Enbridge. The DOC is basing its appeal on the fact that the Certificate of Need was granted without the PUC considering a long-term range demand forecast. The Court is expected to hear the appeal in early 2021.
Suggested Response:
• Since day one, our government has made getting our resources to market a top priority to support good, well-paying jobs in our energy sector.
• We believe there is a need for the Line 3 project as it brings improved environmental performance, increased Indigenous involvement, and economic benefits on both sides of the border.
• The project will generate thousands of full-time jobs during construction, replacing a 50-year-old pipeline with a new and safer one. This would improve the integrity of the pipeline network, reduce the transportation of oil by rail and on public roads, and increase environmental safety.
• Canada will continue to work with our North American partners to enhance our collaboration on environmental and energy issues affecting our continent.
• Canada’s strong climate plan and regulatory regime ensures Canadian products flowing through this pipeline are produced to the highest environmental standards.
• Once fully completed in the U.S., Line 3 will transport 760,000 barrels per day — over 370,000 barrels per day in additional capacity — and further support workers in Canada’s petroleum sector.
• As part of our commitment to reconciliation, Canada continues to work collaboratively with the Line 3 Replacement Program Indigenous Advisory and Monitoring Committee, an initiative that brings together Indigenous representatives, the government, and the regulator to support Indigenous monitoring of the project.
