Suggested Response:

• Our government is determined to see the Trans Mountain Expansion (TMX) project completed.
• We approved TMX because it is in the public interest.
• While we know that Canadians have diverse views on this project, we are confident that we have delivered on our commitment to get this right.
• Pipeline construction is now underway, with Trans Mountain Corporation (TMC) hiring over 2,200 people to work on sites in Alberta and British Columbia, and permitting processes are progressing well.
• Pipe is on site Alberta and will be in the ground before Christmas. TMC anticipates construction will be completed in 30 to 36 months.
INDIGENOUS
• We also continue to strengthen relationships with Indigenous communities as TMX moves forward. This includes working together on initiatives related to Crown commitments, accommodation measures, or any other TMX-related activities.
• With a focus on Indigenous, local and regional workers, the project is providing good jobs for heavy equipment operators, trades people, environment and safety specialists, engineers and construction managers.

Background:

• On June 18, 2019, Prime Minister Justin Trudeau announced that the Government of Canada has approved the Trans Mountain Expansion (TMX) project. As part of this announcement, the Prime Minister also said that all new corporate tax revenues, as well as profits earned from the sale of TMX, will be invested in clean energy projects.
• On September 4, 2019, the Federal Court of Appeal (FCA) granted leave to six of 12 motions for leave to proceed with judicial review of the government’s approval of the TMX project. The six applicants included: Ts’elxwéyeqw Tribe; Stk’emlupsemc Te Secwepemc (SSN); Coldwater; Squamish; Tsleil-Waututh Nation; and Upper Nicola. The FCA limited the issues for the judicial review applications to the adequacy of consultations. On November 4, 2019, SSN and Upper Nicola served the FCA with their respective notices of discontinuance. The hearing is scheduled for December 16-18, 2019.
• On October 29, BC Nature served Canada with an application for leave to appeal the FCA decision to the Supreme Court of Canada (SCC). Following the November 4, 2019, deadline to seek leave to appeal , Canada was served with an additional four applications from Raincoast Conservation Foundation and Living Oceans Society (“Raincoast”); Climate Strikers; Squamish Nation; and Tsleil-Waututh Nation. Three of the applicants (Raincoast, Climate Strikers, BC Nature) were denied leave by the FCA to judicially review the GIC decision. TWN and Squamish Nation were granted leave to challenge the decision, but on limited grounds. Canada’s response to the SCC leave applications will be provided no later than 30 days after a file is opened in the SCC registry.
