Issue/Question:

On April 28, 2023, Public Services and Procurement Canada (PSPC) awarded a $93.1 million contract to Pomerleau Inc. for construction services related to the modernization of the Daniel J. MacDonald Building in Charlottetown, Prince Edward Island after PSPC determined that it had inadvertently and unknowingly erred during the procurement process.

Suggested Response:

  • The Government of Canada is committed to providing a modern, sustainable and efficient workplace for Veterans Affairs Canada to continue to deliver important services and programs to veterans and their families
    • We became aware of the error in the award for the initial contract while reviewing the evidence submitted by the unsuccessful bidder as part of a Canadian International Trade Tribunal complaint
    • After Public Services and Procurement Canada determined it had inadvertently and unknowingly erred during the procurement process, the contract with EllisDon was terminated and a contract was subsequently awarded to Pomerleau Inc
    • We are confident that this approach was the most efficient and fair option to resolve the error. Work can now begin as soon as possible

If pressed on the contract award and related project:

  • Public Services and Procurement Canada has initiated an internal review to identify potential improvements to its policies and procedures in order to prevent a similar situation in the future
  • Public Services and Procurement Canada and Pomerleau Inc. are working to begin construction activities as soon as possible. Construction is still expected to be completed in 2026
